What are the eligibility criteria for stump removal?

There are two main categories of conditions that need to be met for the removal of privately-owned vehicles and vessels to be eligible for FEMA Public Assistance reimbursement:

1. Public Interest and Immediate Threat:

  • Immediate Threat: The vehicles or vessels must pose a clear and imminent danger to life, public health, or safety. This could include blocking access for emergency responders, leaking hazardous materials, or creating a fire hazard.
  • SLTT Government Certification: A written certification from a State, Local, or Tribal (SLTT) government official is required. This document confirms that removing the vehicles or vessels is essential to eliminate the immediate threat.

2. Applicant Eligibility and Responsibility:

  • Legal Authority: The Applicant (usually a government entity) must have the legal right to enter private property and remove the vehicles or vessels.
  • Documentation: The Applicant must maintain records that support the immediate threat posed by the vehicles and the removal process followed.
  • Direct Disaster Result: The damage to the vehicles or vessels must be a direct consequence of the disaster event for which FEMA declared assistance.
  • Unavoidable Damage: The damage shouldn't be due to improper use or neglect of the vehicle/vessel by the owner.
  • Responsibility for Repair: The Applicant must be legally responsible for repairing any damage caused by the removal process on the private property.

Additional Considerations:

  • Obstruction: In some cases, FEMA may consider removal if the vehicles or vessels block access to a public area.
  • Abandoned:  If the vehicle or vessel is abandoned, FEMA might be more likely to approve removal.
  • Local Regulations: The Applicant must adhere to all applicable local ordinances or laws regarding private vehicle/vessel removal.
  • Vehicle Handling Documentation:  Finally, the Applicant needs to document how they handled the removed vehicle or vessel (storage, disposal, etc.)

By meeting these conditions and maintaining proper documentation, applicants can increase their chances of receiving FEMA Public Assistance for the removal of privately-owned vehicles and vessels after a disaster.
