This is in response to a letter from your office dated June 7, 2016, which transmitted the referenced second appeal on behalf of the City of Sweetwater (Applicant). The Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) deobligation of Public Assistance (PA) funding related to the closeout of 10 Project Worksheets in 2012 under the major disaster declaration for Hurricane Irene (FEMA-1345-DR-FL) in 1999. The Applicant now seeks reinstatement of $4,430,092.00 in PA funding. As explained in the enclosed analysis, I have determined that, pursuant to 44 C.F.R. § 206.206(c), the Applicant’s appeal is untimely. The appeal also lacks documented justification in accordance with 44 C.F.R. § 206.206(a) and FEMA policy. In addition, FP-205-081-2, Stafford Act Section 705, Disaster Grant Closeout Procedures, does not apply because the Applicant’s second appeal rights lapsed, and even if it did, the Applicant has not demonstrated with adequate documentation that the costs were reasonable and the purpose of the grant was accomplished. Accordingly, I am denying the appeal. Please inform the Applicant of my decision. This determination is the final Agency decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
