Time Extension - Temporary Facility, Improved Project - City of Springfield

This is in response to a letter from your office dated July 14, 2014, which transmitted the referenced second appeal on behalf of the City of Springfield (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of a time extension for a temporary facility and $495,000.00 in associated costs during construction of an improved project. As explained in the enclosed analysis, I have determined that the Regional Administrator correctly based the period of performance for the temporary facility on the estimated time necessary to repair a comparable facility damaged by the same disaster, pursuant to Disaster Assistance Policy (DAP) 9523.3, Provision of Temporary Relocation Facilities (Dec. 14, 2010). Accordingly, I am denying the second appeal. By copy of this letter, I am requesting the Regional Administrator to take appropriate action to implement this determination. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. §206.206, Appeals.
