This is in response to a letter from your office dated April 10, 2014, which transmitted the referenced second appeal on behalf of the City of Ft. Lauderdale (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of $9,957,555.00 associated with debris removal work in PW 2932. As explained in the enclosed analysis, I have determined that the Applicant’s debris removal work is within the scope of work. Additionally, the Applicant has provided adequate documentation to substantiate reimbursement of costs associated with Temporary Debris Reduction Storage operations. Lastly, the Applicant sufficiently demonstrated that the average unit rate charged by its contractors was reasonable when compared to the unit rates paid by similarly situated applicants from surrounding jurisdictions. By copy of this letter, I am requesting the Regional Administrator take the appropriate action to implement this determination and reimburse the Applicant $9,957,555.00. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
