Stafford Act 423(a) and 44 C.F.R. 206.206(c)(1) provide that an Applicant must file an appeal within 60 days after the receipt of a notice of the action that is being appealed. More than 5 months elapsed between the date of FEMA first appeal decision and the date the Grantee forwarded the Applicant second appeal to FEMA for consideration.
