If the site is unstable and there is evidence of pre-disaster instability after the facility was constructed; restoration of the facility integral ground is not eligible. Restoration of the facility is eligible only upon the Applicant stabilizing the site and restoring the integral ground.Photographs of the Facility from 2012 to 2017 show predisaster instability to the embankment. The Applicant has not provided documentation attesting to the Facility predisaster condition; and thus it cannot be determined that the Facility was stable prior to the incident.
