This is in response to a letter from your office dated June 19, 2018, which transmitted the referenced second appeal on behalf of Lafourche Parish School Board (Applicant). The Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of its first appeal, and requests that FEMA reinstate the $428,681.41 in prior loss reductions applied during the closeout process for Project Worksheet (PW) 588. As explained in the enclosed analysis, I have determined that the mold remediation work performed in PW 588 constitutes eligible Category B emergency protective measures, and thus is not subject to the prior loss reduction provision under 44 C.F.R. § 206.253(b)(2). Accordingly, I am granting the appeal. By copy of this letter, I am requesting the Regional Administrator take appropriate action to implement this determination, including a review of the record to avoid any duplication of benefits. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
