Pilot Program Insurance Permanent Relocation - City of Purcell

This is in response to a letter from your office dated September 25, 2018, which transmitted the referenced second appeal on behalf of the City of Purcell (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of $1,088,703.15 for relocation and other expenses related to its Public Works Campus. As explained in the enclosed analysis, I have determined that the Applicant did not meet the requirements to participate in the Public Assistance Alternative Procedures Program. In addition, the Stafford Act mandates a reduction in the amount of Public Assistance funding for a facility that is insurable under the National Flood Insurance Program (NFIP), and FEMA appropriately reduced the Applicant’s funding by that amount. Finally, FEMA did not approve relocation for this project, and as such, funding for ancillary facilities is not eligible. Accordingly, I am denying this appeal. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
