This is in response to a letter from your office dated July 31, 2018, which transmitted the referenced second appeal on behalf of the Winston County Board of Supervisors (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of $1,615,670.00 in excess funds under the Public Assistance Alternative Procedures Pilot Program for Permanent Work. As explained in the enclosed analysis, the Applicant’s request to use $1,615,670.00 in excess funds is in advance of the procedural timeline under the Public Assistance Alternative Procedures Pilot Program for Permanent Work. Accordingly, this appeal is denied. Please inform the Applicant of my decision. This determination is the final decision on the matters pursuant to 44 C.F.R. § 206.206, Appeals. However, the Applicant may file a timely request to use excess funds upon total project completion.
