This is in response to a letter from your office dated September 28, 2018, which transmitted the referenced second appeal on behalf of the South Carolina Department of Transportation (Applicant). The Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s denial of $3,602,880.00 in costs associated with the removal and disposal of Household Hazardous Waste (HHW) due to noncompliance with Federal procurement regulations. As explained in the enclosed analysis, I have determined that the Applicant has not demonstrated that its contractor’s costs of $60.00/lb to remove HHW were reasonable, nor that the second highest bid of $25.00/lb was reasonable. In addition, the Regional Administrator’s enforcement action finding $6.00/lb reasonable was appropriate. Accordingly, I am denying this appeal. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
