This is in response to a letter from your office dated March 26, 2018, which transmitted the referenced second appeal on behalf of Port Arthur Independent School District (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s denial of $109,991.99 for emergency protective measures to the Edison Middle School. As explained in the enclosed analysis, I have determined that the Regional Administrator (RA) correctly affirmed FEMA’s initial eligibility decision that the Applicant failed to comply with Federal grant procurement standards. To remedy the noncompliance, FEMA properly awarded reasonable costs as a discretionary enforcement action. Accordingly, I am denying this appeal. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
