This is in response to a letter from your office dated March 10, 2016, which transmitted the referenced second appeal on behalf of Big Elk Meadows Association (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s determination that Meadow Lake is not an eligible facility under the Public Assistance program. As explained in the enclosed analysis, I have determined that Meadow Lake is part of a network of lakes comprising a water supply system. However, FEMA has already funded the percentage of space dedicated to eligible services for the entire system of lakes. Therefore, additional assistance for Meadow Lake is not available. The water flow meter at Meadow Lake is a component of a water supply system. Consequently, repairs to it are eligible for Public Assistance. Accordingly, I am partially granting this appeal. By copy of this letter, I am requesting the Regional Administrator to take appropriate action to implement this determination. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
