This is in response to a letter from your office dated December 4, 2017, which transmitted the referenced second appeal on behalf of Palm Beach County, Florida (Applicant). The Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) decision to uphold the deobligation of $398,156.00 in Public Assistance funding based on an untimely first appeal submission. As explained in the enclosed analysis, I have determined that a procedural error negated the Applicant’s opportunity to provide documentation related to the timeliness of its appeal. Accordingly, I am remanding the appeal to FEMA Region IV to issue a new Final Request for Information that addresses any potential timeliness issues, and a first appeal determination that considers any responses submitted by the Applicant or the Florida Division of Emergency Management. Please inform the Applicant of my decision. The Applicant’s right to a second appeal is not impacted by this decision. It may re-submit a second appeal pursuant to 44 C.F.R. § 206.206 if dissatisfied with the Regional Administrator’s decisions regarding this matter.
