This is in response to a letter from your office dated March 31, 2017, which transmitted the referenced second appeal on behalf of Bethel Missionary Outreach Ministries, Inc. (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of the Applicant’s request for Public Assistance (PA). As explained in the enclosed analysis, I have determined the Applicant’s second appeal, filed almost four years after FEMA’s response to the Applicant’s first appeal, is untimely. Additionally, I find the Applicant did not demonstrate that the primary use of its Facilities were eligible for PA; did not have a legal responsibility to repair the leased building; and did not show its losses exceeded the amount received through a Small Businesses Administration loan. Accordingly, I am denying this appeal. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
