This is in response to a letter from your office dated October 24, 2016, which transmitted the referenced second appeal on behalf of the Port of Galveston (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s denial of funding in the amount of $1,147,844.17 for repairs to several facilities. As explained in the enclosed analysis, I have determined that the Applicant’s second appeal is time-barred by the Robert T. Stafford Disaster Relief and Emergency Assistance Act § 423(a) and 44 C.F.R. § 206.206. Accordingly, I am denying the appeals. Please inform the Applicant of my decision.
