Increased Operating Expenses - University of Texas Medical Branch

This is in response to a letter from your office dated September 5, 2014, which transmitted the referenced second appeal on behalf of the University of Texas Medical Branch (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) first appeal determination that the emergency protective measures taken for on-going treatment of Legionella within the domestic hot water distribution system of the Healthcare Core Complex are ineligible for Public Assistance funding beyond August 25, 2011. As explained in the enclosed analysis, the costs associated with continuous CSI treatments and regular replacement of point-of-use filters are increased operating expenses rather than costs associated with emergency work. Additionally, the work occurred after the approved period of performance deadline. As such, the appeal is denied. Please inform the Applicant of my decision. This determination constitutes the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
