This is in response to your letter dated April 6, 2016, which transmitted the referenced second appeal on behalf of Trenton Special School District (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of funding in the amount of $32,135.16 for costs related to the improvements to the pre-kindergarten playground at Trenton Elementary School. As explained in the enclosed analysis, I have determined that the costs claimed by the Applicant associated with the playground are ineligible because they are part of the project’s improvements and funding is capped at the estimated costs in accordance with 44 C.F.R. § 206.203(d)(1). Accordingly, I am denying this appeal. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
