This is in response to a letter from your office dated July 10, 2014, which transmitted the referenced second appeal on behalf of Clarksville Gas and Water (Applicant). The Applicant appealed a total of seven PWs; the remaining PWs will be addressed in separate appeal responses. Regarding PW 5451, the Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of $559,964.86 in Public Assistance (PA) funding to restore the damaged gas pipes located below Sycamore Creek. As explained in the enclosed analysis, I have determined that the Applicant’s requested scope of work, utilizing directional boring, is acceptable and eligible for PA funding. Therefore, I am granting the appeal, contingent upon FEMA’s ability to validate proper procurement and reconcile actual costs at closeout. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
