This is in response to a letter from your office dated July 10, 2014, which transmitted the referenced second appeal on behalf of Clarksville Gas and Water (Applicant). The Applicant appealed a total of seven PWs; the remaining PWs will be addressed in separate determination letters. Regarding PW 5374, the Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of an additional $126,029.71 in Public Assistance (PA) funding requested for excluded work items for the Primary Clarifier Complex. As explained in the enclosed analysis, I have determined the Applicant failed to demonstrate that the requested work items are eligible under the PA Program pursuant to 44 C.F.R. § 206.223. Therefore, I am denying the appeal. Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
