Insurance Reductions - Nashville-Davidson County

This is in response to a letter from your office dated September 18, 2012, which transmitted the referenced second appeal on behalf of the Metropolitan Government of Nashville-Davidson County (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency (FEMA) reduction of anticipated insurance proceeds from the amounts awarded under three Project Worksheets addressing damage to water system tunnels and a recreation trail caused by flooding in 2010. As explained in the enclosed analysis, the Applicant’s insurance policy does not provide coverage for the damage under the three PWs. Consequently, that portion of the Applicant’s appeal is granted and $213,401.63 reductions to the subject named Project Worksheets should be restored. However, the applicant did not provide justification for its Direct Administrative Costs, and therefore that portion of the appeal is denied. Please inform the Applicant of my decision. This determination constitutes the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
