The Applicant must demonstrate extenuating circumstances or unusual project requirements beyond the control of the applicant to justify granting a time extension request. The Applicant’s documentation shows that it was ordered by the Governor to reallocate resources towards patient care because of the COVID-19 pandemic. This reallocation of funding, not within the Applicant’s control, resulted in insufficient resources due to the COVID-19 pandemic. Accordingly, the Applicant has demonstrated that extenuating circumstances beyond its control justify the last requested time extension.
FEMA finds that the Applicant has demonstrated that extenuating circumstances beyond its control justify the final time extension for both projects through November 8, 2022. Therefore, this appeal is granted.
