HEADNOTES

Pursuant to 44 C.F.R. § 206.204(c)(2)(ii) and (d)(2), an applicant seeking a time extension from a regional administrator must document an extenuating circumstance or unusual project requirements beyond its control.

CONCLUSION

: Labette County changed the SOW without prior approval from FEMA, failed to establish extenuating circumstances justifying a time extension, and did not complete the project by the expiration of the last time extension. Therefore, this appeal is denied.
