An eligible item of work must be required as a result of the disaster event. For permanent work, an applicant must demonstrate that damage was caused by the declared incident; FEMA does not provide funding for repair of damage caused by deterioration or deferred maintenance. FEMA noted deterioration of the roof that predated the disaster at its inspection of the Facility. The Applicant has not provided documentation showing the predisaster condition or that it maintained the Facility’s roof. FEMA noted at its inspection that the windows of the Facility were intact and were leaking due to a lack of sealant, a pre-existing maintenance issue. FEMA has authority to provide PA funding for cost-effective hazard mitigation measures for facilities damaged by the incident. The Applicant acknowledges the Facility wall was already damaged by a prior disaster. The Applicant has not provided documentation that the wall was damaged by this disaster and therefore the wall is not eligible for hazard mitigation measures.
The Applicant has not shown that work to repair claimed damage to the Facility’s roof, windows, or wall was a direct result of the disaster. Accordingly, the second appeal is denied.
