To be eligible, a Community Development District (CDD) must own and be legally responsible for maintenance, and operation of an eligible facility that is open to and serves the general public. When a facility maintained by a CDD is not open to the general public or does not provide a service to the general public, the facility is ineligible. The Facility is not open to the general public and does not provide a service to the general public and is thus ineligible for PA.
The Applicant has not demonstrated the Facility is open to serves the general public, and thus, the Facility is not eligible for PA. Therefore, the appeal is denied.
