HEADNOTES

To be eligible for PA, a PNP applicant must own or operate an eligible facility. An eligible PNP facility includes one that provides educational, utility, emergency, medical, or custodial care services, or other essential social service to the general public. The Applicant does not own or operate an eligible PNP facility which provided an eligible critical or noncritical essential service to the general public. Therefore, the Applicant is not an eligible PNP applicant.

CONCLUSION

The Applicant is not an eligible PNP applicant, because it does not own or operate an eligible PNP facility. Additionally, the Applicant has not demonstrated that the debris removal from its private roads is eligible. The appeal is denied.
