A museum is eligible as a PNP facility that provides essential social-type services if it preserves and exhibits a documented collection of artistic, historic, scientific or other objects. The grounds at museums and historic sites are not eligible. The dam does not preserve or exhibit a documented collection of objects. The dam is part of the grounds at a museum. An applicant’s appeal of an eligibility determination must contain documented justification supporting the applicant’s position. The Applicant has not provided documentation that the dam provides educational, utility, emergency, medical, or custodial care, including for the aged or disabled, and other essential social type services to the general public.
The Applicant has not demonstrated that the dam is an eligible PNP facility. Accordingly, the second appeal is denied.
