FEMA finds the Applicant has not demonstrated its claimed costs for supplies are related to eligible emergency protective measures that eliminate or lessen an immediate threat or an eligible activity for the safe opening and operation of an eligible facility. Furthermore, the Applicant, a PNP, has not demonstrated it was legally responsible for providing NCS under FEMA’s COVID-19 policies. Therefore, the appeal is denied.
