For emergency protective measures to be eligible, the applicant is responsible for showing the work is required due to an immediate threat resulting from the declared incident. The Applicant has not demonstrated that the installation of the magazine rack and drop box either eliminated or lessened an immediate threat.

The Applicant has not demonstrated that the work to install the drop box and magazine rack constituted eligible emergency protective measures taken to respond to an immediate threat.
