FEMA must approve all alternate projects prior to the start of construction. If the project is not completed, no Federal funding will be provided for that project. FEMA determines that the Applicant did not complete the SOW for the five PWs and did not demonstrate that FEMA approved the PWs as alternate projects.

FEMA finds the Applicant did not complete the SOW for the five PWs and the administrative record does not establish that FEMA approved the PWs as alternate projects. As such, FEMA will not reinstate the deobligated funding. Therefore, this appeal is denied.
