Temporary emergency repair or stabilization for the purpose of eliminating or lessening an immediate threat is emergency work. The repair of damages caused during the performance of eligible emergency response activities may be eligible as part of that respective emergency project. Work required to restore a facility damaged or destroyed by a disaster to its predisaster design and function in accordance with applicable codes and standards is permanent work. The eligible work captured in Grants Manager Project 132833 is for emergency work due to an immediate threat resulting from the incident and not for permanent work to address damage caused by the declared incident. Claimed work associated with codes and standards upgrades are not eligible as there is no corresponding eligible permanent work.
The codes and standards upgrade work proposed by the Applicant is ineligible because it is not associated with an eligible permanent work project. Therefore, the appeal is denied.
