It has been determined that emergency and exigent circumstances exist based on the President’s Nationwide Emergency Declaration and the Secretary of the Health and Human Services’ (HHS) declaration of a Public Health Emergency for COVID-19. Therefore, non-state entities are permitted to non-competitively procure contracts pursuant to 2 CFR § 200.320(f)(2) for the duration of the COVID-19 Public Health Emergency as determined by HHS.
